SMB Studio, LLC ("Company" or "We") respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This Policy describes what information we collect, how we use and share it, and your rights and choices regarding your information, when you use our Sleep Orbit mobile application, our website (if any), and any related services (collectively, the "Services").

By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our policies and practices, do not use the Services. We may update this Privacy Policy from time to time; material changes will be notified to you (for example, via an in-app notice or email), and the latest version will always be posted here with the "Last Updated" date. Your continued use of the Services after we make changes signifies your acceptance of those changes.

Children Under 13

Our Services are not intended for children under 13 years of age. We do not knowingly collect personal information from anyone under 13. If you are under 13, please do not use the Services or provide any information about yourself to us. Parents or guardians should supervise the use of the app by minors. If we learn that we have collected personal information from a child under 13 without parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us so we can promptly investigate and address it.

Information We Collect

We collect various types of information from and about users of our Services, including:

  • Personal Identifiers: Information by which you may be personally identified, such as your name, email address, or other contact information. For example, if you create an account or contact support, you may provide your name and email.
  • User Account and Profile Data: If you register for an account, we may collect login credentials (like username or account ID) and any profile details you provide. If the app offers subscription or in-app purchases, we may collect information about your purchases or subscription status.
  • User-Generated Content: Any content you provide through the app, such as the custom sound mixes you create, audio files you import, or feedback you submit. This may include audio data or other media. (Note: Your mixes and imported sounds are generally stored locally on your device, but metadata or information about how you use these features might be collected by us to sync across devices or improve the app.)
  • Device and Usage Information: When you use the Services, we automatically collect technical information about your device and usage of the app. This includes details like your device type, operating system, unique device identifiers, browser type (if using a website), IP address, and usage data such as features you use and the time/stamps of your activities. For example, we may log when you launch the app, which sound categories you use frequently, and other interaction data. This information helps us understand how users engage with Sleep Orbit.
  • Analytics and Tracking Data: We and our third-party analytics partners may use technologies like cookies, web beacons, or mobile SDKs to collect information about how you navigate and use our Services. This can include pages or screens viewed, time spent, crash reports, and other diagnostic data. This information is generally statistical and does not directly identify you, but if needed we may associate it with your account or personal information to troubleshoot issues and improve the Service.
  • Location Information (if applicable): Sleep Orbit is primarily an offline audio app, and we do not request precise GPS location. However, we may infer general location information (e.g., country or region) from your IP address for purposes such as regional settings or legal compliance. We do not collect your real-time precise location without your explicit permission.
  • Information from Third Parties: If you access the Services through a third-party platform (for example, if in the future we allow "Sign in with Google/Apple" or similar), we might receive certain information from that third party such as your name or email associated with that account. Also, if you make purchases through Apple App Store or Google Play, we will receive information from those stores to confirm your subscription or purchase (but not your full payment card details). Any information collected by third-party platforms is subject to their privacy policies.

We do not collect any sensitive personal data such as government ID numbers, biometric data, health information, or financial account info directly through Sleep Orbit.

How We Use Your Information

We use the information we collect for various purposes consistent with the following:

  • To Provide and Maintain the Service: We use your information to operate Sleep Orbit's features, personalize your experience, and ensure the app functions as intended. For example, we might use your saved mixes data to sync your mixes across devices (if cloud sync is enabled) or use your device type to tailor the app's performance.
  • To Improve and Develop the Service: Your usage data and feedback help us understand how the app is used and where improvements or new features are needed. We analyze this data to fix bugs, optimize audio experiences, and develop new content or functionality.
  • To Communicate with You: We may use your contact information to send you service-related notices such as updates, security alerts, technical support responses, or administrative messages. If you contact us with a question or request, we will use your information to respond. With your consent or as permitted by law, we may also send you promotional communications about new features or promotions for Sleep Orbit; you can opt-out of these marketing emails at any time.
  • To Process Transactions: If you make a purchase (such as upgrading to Sleep Orbit Pro or buying sound packs), we use information to process that transaction. Note: Payments are handled by the platform providers (Apple or Google), so we do not collect or store your credit card number – we receive confirmation of payment and subscription status from them.
  • To Enforce Our Terms and Protect Our Rights: We may use data to enforce our Terms of Service and usage policies, to detect and prevent fraud, abuse, or illegal activities, and to protect the security and integrity of our Services and users. For example, if we detect usage patterns that indicate misuse (like automated scraping or content that violates our terms), we may use relevant data to investigate and take action.
  • To Comply with Legal Requirements: We will use or disclose your information where necessary to comply with legal obligations, such as responding to lawful requests from law enforcement or regulatory authorities.
  • For any other purpose with your consent: If we want to use your information for a purpose not covered by this Privacy Policy, we will explain it to you and get your consent as required.

How We Share or Disclose Information

We value your privacy and handle your personal information with care. We do not sell your personal information to third-party companies for their independent marketing purposes. However, we may share information about you in the following circumstances:

  • With Service Providers and Partners: We share information with trusted third-party service providers who perform services on our behalf to support the operation of Sleep Orbit. For example, these may include cloud infrastructure providers (for data hosting or backups), analytics providers (to help us understand app usage), crash reporting services, or email/message distribution services (to send you support replies or notifications). These service providers are contractually required to only use your information as necessary to provide services to us and to protect your information.
  • With Affiliates: We may share your information with our subsidiaries or affiliates (if any) for purposes consistent with this Policy (for example, if SMB Studio LLC in the future has related products or corporate affiliates that assist in operations).
  • In Connection with Business Transfers: If SMB Studio is involved in a merger, acquisition, sale of assets, bankruptcy, or reorganization, your information may be transferred as part of that transaction to the successor or new owner. If such a transfer occurs, the successor entity will be bound by this Privacy Policy or one with materially similar protections for your data.
  • For Legal Compliance and Protection: We may disclose information to third parties (such as attorneys, courts, or law enforcement authorities) when we believe disclosure is necessary to comply with a legal obligation, subpoena, or governmental request, or to enforce our Terms of Service and other agreements or policies. We may also disclose information if we believe it is necessary or appropriate to protect the rights, property, or safety of SMB Studio, our users, or others. For instance, we might share information with law enforcement if required to investigate fraud or a security incident.
  • With Your Consent or At Your Direction: We will share your personal information with third parties if you request or consent to such sharing. For example, if you explicitly opt-in to a feature that involves sharing data with a third-party app or if you ask us to share your feedback as a testimonial on our website, we would do so with your consent.
  • Aggregated or De-Identified Data: We may share information that has been aggregated or anonymized (so it can no longer be linked to you personally) without restriction. For example, we might publish statistics about how many users use certain categories of sounds, or the average session length, as these do not identify any individual.

Important: Any content you choose to publicly post (if the app ever introduces community features or if you share a mix publicly) could be seen by others. Currently, Sleep Orbit does not have public social sharing within the app (no public profiles or forums in-app), but if you choose to export audio and share it externally, that is under your control. This Privacy Policy does not cover information you make publicly available on your own (e.g., posting a screenshot of your mix on social media).

Cookies and Tracking Technologies

Cookies & Similar Tech: While Sleep Orbit is primarily a mobile app, if there is a Sleep Orbit website or web portal, we (or our partners) may use cookies (small text files stored in your browser) and similar technologies like web beacons or mobile app analytics SDKs to collect usage information. Cookies on our website might help remember your preferences, keep you logged in, or gather analytics about site traffic. You can typically set your browser to refuse some cookies or alert you when cookies are being used. However, note that certain parts of the Service might not function properly if you disable cookies.

Analytics: We use third-party analytics services (such as Google Analytics for Firebase, or similar) to collect and analyze usage data. These services may use identifiers and cookies to help us understand how users engage with the app or website. The information generated will be transmitted and stored by these providers on their servers. We use this information to evaluate usage, compile reports, and improve our Service. These third-party analytics providers may have access to some aggregated data about you, but they are not allowed to use it except to provide services to us under our instructions.

Advertising: Sleep Orbit does not display third-party banner ads or intrusive advertisements in the app (as noted, "No intrusive ads to disrupt your experience"). We may promote our own offerings within the app, but we currently do not use ad networks that track you across different apps. If this ever changes, we will update this Policy and provide appropriate opt-outs. We also do not engage in "interest-based advertising" using your personal information at this time. Should we introduce advertising partners in the future, we will ensure compliance with applicable privacy laws and provide you with choices (like the ability to opt-out of targeted ads).

Your Choices and Rights

We strive to provide you with choices regarding your personal information. Depending on your location and applicable laws, you may have certain rights with respect to your data:

  • Access and Correction: You may request access to the personal information we hold about you and ask that we correct or update it if it's inaccurate or incomplete. For example, you can update your account information (like your email) by contacting support if there is not an in-app profile edit option.
  • Deletion: You can request that we delete the personal data we have collected from you. Keep in mind, we may need to retain certain information for legitimate business or legal purposes (e.g., records of transactions or for security). If you request deletion, we will remove your personal info to the extent required by applicable law and inform you of the outcome.
  • Data Portability: You have the right to request a copy of your personal data in a commonly used, machine-readable format, and/or to have us transmit it to another service where technically feasible.
  • Opt-Out of Marketing: If we send you marketing emails, you can opt out at any time by clicking the "unsubscribe" link in those emails or contacting us. (Transactional or service-related communications, such as subscription confirmations or critical updates, may still be sent as they are not promotional.)
  • Opt-Out of Analytics/Tracking: Most analytics SDKs in mobile apps can be disabled by opting out of analytics in the app settings if available, or by enabling a "Limit Ad Tracking" or similar privacy setting on your device. While we don't serve targeted ads, if any tracking for analytics makes you uncomfortable, you can also contact us to inquire about opting out. On our website, you can refuse cookies as described above.
  • State Privacy Rights (U.S.): Residents of certain U.S. states have specific legal rights regarding personal information. For example, California residents have rights under the California Consumer Privacy Act (CCPA/CPRA) including to know what personal information we collect, disclose, or sell (we do not sell personal data), to request deletion or correction of their personal information, to opt out of "sharing" of personal info for targeted advertising, and to not be discriminated against for exercising these rights. Other states (such as Colorado, Connecticut, Virginia, Utah, etc.) provide similar rights. Sleep Orbit will honor applicable state privacy rights. If you are a resident of California or any state with a comprehensive privacy law, you may contact us to exercise your rights of access, deletion, correction, or opt-out of certain processing. We will verify your request and respond within the timeframe required by law. Specifically, under CCPA, we provide the following disclosures:
    • We collect the categories of personal information described in Information We Collect above (identifiers, usage data, etc.) for the purposes described in How We Use Your Information.
    • We do not sell your personal information, nor do we share it with third parties for cross-context behavioral advertising without your consent.
    • We may disclose certain categories of information with service providers (e.g., identifiers with our analytics or cloud service providers) for business purposes, as described in How We Share Information.
    • California residents may designate an authorized agent to make a request under CCPA on their behalf, but we will require verification of the agent's authority and your identity.
  • EEA/UK Data Subject Rights: If you are located in the European Economic Area (EEA) or United Kingdom, you are entitled to certain rights under the General Data Protection Regulation (GDPR) or UK GDPR. These include the right to access your data, to rectify inaccurate data, to erasure (the "right to be forgotten"), to restrict processing of your data under certain conditions, to object to processing (especially for direct marketing or where processing is based on our legitimate interests), and the right to data portability. Where we rely on your consent to process data, you have the right to withdraw consent at any time. You also have the right to lodge a complaint with your local supervisory authority if you believe we have infringed your privacy rights. To exercise any of these rights, please contact us using the information in the Contact section. We will handle requests in accordance with applicable law, and note that these rights may be subject to certain exemptions or limitations (for instance, we might not delete data we are required to keep for legal obligations, or we might deny a request if it adversely affects others' rights).
  • Do Not Track Signals: Some web browsers have "Do Not Track" (DNT) features. Given there is not yet a consensus on how to interpret DNT signals, our website (if used) does not currently respond to them. We await industry or legal standards on this. However, as noted, we do not track users across third-party sites or services.

Data Security

We take reasonable measures to protect your personal information from unauthorized access, use, alteration, and disclosure. These measures include using encryption where appropriate, secure protocols for data transmission, and limiting access to personal data to authorized personnel who need it for their job. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee its absolute security. You are also responsible for maintaining the security of your account credentials (if any) and for any activities done under your account due to your own negligence in protecting those credentials.

If we become aware of a data breach that affects your personal information, we will notify you and relevant authorities as required by law.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of providing the Service and satisfying any legal, accounting, or reporting requirements. For example, if you have an account, we will keep your account information while your account is active. If you request account deletion, we will delete or anonymize your personal data within a reasonable period, except for information we are required or permitted to keep by law (e.g., records of transactions for financial reporting, or logs for security and fraud prevention). We also periodically review the data we have and delete or anonymize information that we no longer need for business or legal purposes.

Backup and residual copies of personal information might persist for a limited period in our systems (such as in encrypted backups) but will be purged according to our data retention policies.

International Users and Data Transfers

Sleep Orbit is operated from the United States. If you reside outside the U.S. and use our Services, please be aware that your information will be transferred to and processed in the United States and possibly other countries. These locations may not have the same level of data protection laws as your home country. We will take steps to ensure that appropriate safeguards are in place to protect your data in transit and at rest, in compliance with applicable data transfer requirements. For example, for EEA users, if we transfer personal data outside the EEA, we may rely on European Commission approved standard contractual clauses or other legally acceptable mechanisms to ensure adequate protection. By using the Service, you acknowledge this transfer and processing of your personal information.

We may update this Privacy Policy from time to time. If we make material changes to how we handle personal information, we will notify you by appropriate means, which may include an in-app alert, an email notification, or posting a prominent notice on our website. The "Last Updated" date at the top of this Policy reflects the date of the most recent changes. Your continued use of the Services after any changes to this Policy will be deemed acceptance of those changes.
